The Immigration Reform and Control Act of 1986

The Immigration Reform and Control Act of 1986, referred to as "IRCA". This law is designed to protect jobs and make them available only to U.S. citizens and individuals legally authorized to work in the United States.

IRCA forbids any employer or entity from hiring, recruiting, or referring for a fee, after November 6, 1986, any alien knowing that the alien is unauthorized to work in the United States. Violators are subject to both civil and criminal sanctions.

In addition, IRCA makes it illegal to hire any individual without complying with certain verification requirements. Employers must document all workers except those hired prior to November 6, 1986, by completing the Employment Eligibility Verification Form I-9.

Most employers are aware of IRCA's laws which prohibit the hiring of illegal aliens - individuals not authorized to work in this country. However, few employers are aware that IRCA prohibits discrimination based upon a person's citizenship status or national origin.
